In New Hampshire, mothers have the right to breastfeed in any public location, as long as they are legally allowed to be there. The federal FLSA’s PUMP Act provides workplace lactation accommodation protections for all breastfeeding employees, and effective July 1, 2025, New Hampshire has additional state-level workplace protections.

NH Breastfeeding Laws: At Work

All breastfeeding employees are protected by the federal FLSA’s PUMP for Nursing Mothers Act and entitled to reasonable break time and a private space (other than a bathroom) to pump at work for one year after the birth of a child. Effective July 1, 2025, New Hampshire law requires employers with six or more employees to provide break time and a private non-bathroom lactation space to pump at work. Unlike the federal PUMP Act, the NH law defines reasonable break time as “an unpaid break of approximately 30 minutes for every 3 hours of work performed by a nursing employee for the purpose of expressing milk.” Breastfeeding employees must notify their employers at least two weeks in advance that they will need lactation accommodations at work. Breastfeeding mothers in New Hampshire are exempt from indecent exposure laws.

NH state workers can bring their babies (between the ages of six weeks and six months) to work with them if they work for a state agency that has opted into the program. The program, 'Infants in the Workplace' initiative, was signed as an executive order by Governor Sununu. Read the order: Executive Order 2019-08
